P4 wasn't.

Intel isn't going on trial over nehalem, it's going on trial over what it did during the P4 days.

Intel should have settled while Bush was running the Justice department, now Intel faces a very different mentality in charge of the bureaucracy.

Intel also will be going to trial during a period in which there is a very different view of corporate management in general. I'm almost sympathetic to Intel on this front, they may have abused their monopoly to cheat their customers but they never approached the scale of deceit of the financial industry. Now they're going to be tarred with the same brush.
