Attorneys serve a good purpose in settling disputes in a fair manner (fair will be subjective on the individual set of circumstances). You will need to weigh the cost benefit of pursuing a lawsuit. 1st you will need to be able to prove your damages. Do this b/4 you engage an attorney. By this you will need to prove the trade(s) that did or didn't go through and the market value of the trades (with commissions) at the time they should have gone through (details but you need this).

You will have a very difficult time (if not impossible) of proving a phamton (lost) gain if you only have a record of initiating a purchase that didn't go through and since that didn't go through and you didn't have the ability to "pull" the trigger on closing the position you'll have no proff. If you have no proff on the sale and gain I think you have a weak case.

A quick garbled story:

Just spent yesterday in court and appx. 120 hours in the previous month preparing for the appointment. This is for a client in a messy divorce proceeding. I'd say to date my client has incurred over $60k in professional fees (my accounting fees are a small piece) and the spouse probably half that.

All I did yesterday was sit and watch other court proceedings as the two sides attorneys negotiated out of court (5 hours sitting on my hands and my client has to pay for that). All that was done was alimony was agreeed upon (which was basically in accordance with a pre nup agreement) until the next court date.

I sat next to my client the whole time (a victim of alhizmers but the client remembered who I was yesterday so it was good from that point).

This case will be settled out of court but I'd expect another round of proceedings before both sides decide to settle. A lot of money will be spent that would be better served going to the two clients but thats the system. My client is basically spending money so that the pre nup is enforced.
