Heads up. I received a reply back from Scott Selig from
Siskinds dated 11NOV09. Mr. Selig couldn't/wouldn't answer my question about enough evidence to seek a criminal investigation. However, he appears VERY interested in finding out where the information came from, regarding the "Buy Back" from Versa that Allan Vanguard hopes to achieve within 12-18 months. I will advise him Beaverfeaver found this information in the redacted Schedule A on the Sedar report.

Further, I will advise him to contact you directly Beaverfever...otherwise, would you please send him an email with your findings as I don't know where to look.

This is Mr. Selig's reply back to me.

Thank you for your correspondence. Our firm is continuing to pursue civil remedies against Allen-Vanguard and the other named defendants on behalf of our client and the proposed class of individual shareholders.

In response to your question, Siskinds does not have any criminal lawyers on staff and as such I am unable to provide you with legal advice as to whether VRS security holders should ask for a criminal investigation. That being said, if you are in possession of evidence that suggests a criminal case should be brought I would strongly urge you to contact your local law enforcement agency or the RCMP.

Please note that a criminal investigation is not structured to provide security holders who suffered financial losses with individual monetary compensation. In contrast, civil proceedings, such as the class action that our firm has filed, are structured (to) address situations where individuals or groups have suffered financial loss and are seeking restitution.

Lastly I note that you stated, in your original email to the OSC, that one of the reasons to commence a criminal investigation was due to "Back-door documentation permits Allen-Vanguard to buy-out Versa within 12-18 months at cost plus a small premium." ARE YOU ABLE TO FORWARD ME THIS INFORMATION?

If you have any further questions please do not hesitate to contact me.

Regards,
Scott Selig.
