It's not airtight. They were not read their rights and they were water boarded. You can argue if water boarding is torture or not. But if they are to have the same justice as a private citizen then if they were forced to admit their guilt, as well as other information by water boarding, then under that system they should walk free.

After a military tribunal, if after finding they will be life long enemies of our country, then they should be properly hung.
