They were not read their rights and they were water boarded. You can argue if water boarding is torture or not. But if they are to have the same justice as a private citizen then if they were forced to admit their guilt, as well as other information by water boarding, then under that system they should walk free.

Presumably, Holder recognizes that substantial portions of the evidence will be ruled inadmissible (more likely, he won't even try to introduce those items), yet, he believes there is still sufficient evidence that IS inadmissible to give him confidence in a conviction.

The entire thing is just wrong-headed on so many levels.

Most importantly, you don't try someone in a criminal court for acts of war. Trying these people like this is a stunning mistake that only our current president could make.

An acquittal or even a mistrial will be viewed as a defeat for America and the trial, regardless of outcome, substantially increases the threat of terrorism against us.
