An attorney acquaintance sent the following in an email, regading the NYC "trial" or circus:

Read your Powerline entries from Judge Mukasey. My fear is the discovery process that will allow KSM to find out state secrets, including informant names. Our failure to provide certain discovery under the rules could allow him to seek a dismissal.

The other concern is that when KSM was arrested, we did not treat the place of arrest as a crime scene and gather evidence in the way we would at a crime scene. I can see the defendants challenging the chain of custody and other evidence gathering issues. Of course, when some one is shooting at you, it is probably not prudent to put up "crime scene tape" to corden off the area. It is probably more practical to get your war criminal out of the area while laying down cover fire.
