The part that concerns me is the section explaining why the military tribunal was not pursued. Basically Obama is changing the rules of military tribunals, which would make them almost unviable for the vast majority of enemy combatants we have in custody.

It is my belief that the Justice Department wasn't really given a set of viable options. They're being tried in a civilian court because Obama pretty much steered them that way. Whether the Justice Department did their homework or not is irrelevant.

Of course, Obama isn't stupid, so if there is any chance that KSM walks, it'll be Obama who takes the fall. Blaming Bush might be easy for you, but it certainly won't be for him, so in that sense he might already have the bases covered. But I remain skeptical; after all, Obama has made blunders and miscalls before.
