Interests and Rights:

Interests: Let’s consider interests first. As I’ve used the term ‘best interests of the child,’ we are looking more at natural interests than personal attractions. The natural interests of a child would be having their health and welfare encouraged, supported and guarded by a beneficent care taker. Whether or not they get to watch a particularly interesting Disney movie being outside the scope of that definition. An attentive guardian knows where support for enthusiasm is healthy and beneficial for an individual child, which is one of the reasons why this one on one relationship is seen as natural.

The role of parent assumes it is also in the natural interest of the parent to find joy, comfort, and other rewards in supporting the growth and development of their child. Whether or not the parent gets to have beers with buddies on a Friday night would be outside the scope of that definition. Since adults are multi-dimensional in their role playing, juggling of roles is a complex issue for everyone. Conflicts arise only when one is indulgent or when a third party attempts to control the situation.

Rights: When considering what is naturally right for an individual you have three choices.

1. The idea that the natural rights of human beings consist entirely of liberties to pursue everything at will, which would include whatever one could gain at the expense of others. This situation inevitably leads to what Hobbes referred to as a war of all against all.

2. The idea that the natural rights of man consist of a regard for the well being of self and others guiding one to the goal of maximizing well being of self while maintaining the righteous regard for others.

3. The third idea is kind of a compromise between one and two. The skeptics idea that a sovereign and coercive power is needed to afford the opportunity for all human beings to seek well being with laws forbidding the abuse of others. This approach assumes of course that the Sovereign power is itself above reproach where laws are intended to protect natural rights rather than further them or serve some other purpose.
