Why on Earth would they do that? That's what everyone's wondering - why try these guys in NYC - unless the point is to piss away millions of dollars for no reason other than to appease liberal pinheads that want to see waterboarding and the CIA on trail. The military has no idea now whether they can press captured combatants for information or whether should read them miranda first and get a lawyer.
