BILL OF PARTICULARS
NOW COMES the United States of America, by and through Sally Quillian Yates, Acting United States Attorney, and Gerald S. Sachs Gerald S. Sachs, Special Assistant United States Attorney, and hereby files this Bill of Particulars specifying that, the Government is seeking a sum of money equal to at least $7,000,000.00, and as a result of any act or omission of the defendant, the forfeitable property:
(a) cannot be located upon the exercise of due diligence;
(b) has been transferred or sold to, or deposited with, a third party;
(c) has been placed beyond the jurisdiction of the court;
(d) has been substantially diminished in value; or
(e) has been commingled with other property which cannot be divided without difficulty;
it is the intent of the United States, pursuant to 21 U.S.C. § 853(p), as incorporated by 18 U.S.C. § 982(b), to seek forfeiture of any other property of the defendant up to the value of the above-stated money judgment, including but not limited to the following:
a. Real property located at 2646 Hunters Place Landing, Grayson, Gwinnett County, Georgia, more particularly described as:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 122 OF THE 5TH DISTRICT, GWINNETT COUNTY, GEORGIA, BEING LOT 120, BLOCK A, THE HERITAGE AT GRAYSON, UNIT ONE, AS PER PLAT RECORDED IN PLAT BOOK 103, PAGES 222-224, GWINNETT COUNTY RECORDS, SAID PLAT BEING
INCORPORATED HEREIN BY REFERENCE THERETO.
