I did do a bit more research on the filing requirements and have spoken to two lawyers. Unfortunately, as so often when it comes to the law, there is no clear cut answer AND there is no one willing to push the point / incur legal fees at this stage as it's not a "crucial issue" until VRS presents their case to a court / judge.
Basic conclusion:
VRS remains a Canadian public company and as such is bound by disclosure rules and regulations until a court decides that it is no longer a public company but there is no point in pushing it as they will have to disclose current financials as part of their court filing which has yet to happen (as far as I know).

It's important to remember that this deal can't close / is nothing but smoke and mirrors without court approval. Ergo, there is NO deal right now!

Lots of interested parties just cooling their heels right now as it's up to VRS and cohorts to make the next move.
