It is PHYSICIANS who are demanding protecting from the litigation which would eliminate the need for defensive medicine.

Defensive medicine are only a part of the picture. Malpractice and liability premiums can amount to as much or more - cost-wise. Since having this insurance is cost of doing business, it gets passed on in doctor and hospital fees.
