Maurice, the reason for my extreme example was to show that (amongst reasonable people) it isn't a question of whether or not there should be any protection, but rather a question of what sort of protection is necessary or desirable. People are not either "regular and self-determining", or not. There is a continuous spectrum of capability. Some 12-year olds are already very sensible, while as you know there are others who never develop the ability to fend for themselves. There are lots of shades of grey, not much clean black and white.

I often chafe against societal restrictions. For example, I got scolded by the ranger for lighting a fire on Anawhata beach to cook some mussels. Fires are prohibited because some drongos can't be trusted not to set the bush alight. I'm confident of my judgment in such things, and resent the way the law treats us as all equally irresponsible. Laws are often very blunt instruments, but it can't be denied that there are many among us who are mentally or ethically challenged.
