The circumstances are totally different, dumbass.

In the case of the pantybomber, the objective is to get intelligence. There is PLENTY of evidence on which to convict the guy, so that isn't the issue.

In the case of GTMO detainees, any intel they might have had has long since been gotten. The issue with these people is EVIDENCE - is there enough evidence to convict them? They weren't taken into custody with 200 witnesses as to their actions, they may have been interrogated by CIA, which means the admissability may be an issue, etc.).

You have tried to take two radically disparate situations and paint them with a single broad brush. Obviously, this is something only an idiot would do.
