Class action . . . more thoughts on patents. . . Brad, it's a bit hard to follow the docket format, but everything looks to be in an early stage. Sounds like the plaintiff succeeded in certifying a class action. Fowler is represented and will not default. Any motion to dismiss is automatically tried, but that doesn't mean it gets any where. It's all too early to tell from this distance what is going on. The Lerach complaint, full of citations to newspaper articles, etc., looked pretty weak in places, but not every where. So we wait. It will be a while before this concludes if it doesn't settle. Looking a little further on the patent front, the IDX patent cited in the "non-minutiae" patent is cited elsewhere 12 times. The "non-minutiae" patent isn't cited any place else. I count these as good signs for IDX's patent position. Still don't know where SACM's patent authority is coming from, if any where. David
