Actually, in doing what you describe, he is saying he rejects the false dilemma between do nothing or complete takeover. Of course, he's stating the obvious. Also, at least one of his rejected positions is a bit of a straw man - if anyone in the political sphere is saying "do nothing", they are a tiny minority. Anyway, in presenting this false dilemma, he is trying to make what the Dems tried to pass seem like a compromise or a moderate proposal (because it is something short of a complete takeover) when it is neither.

BTW, not to pick nits, but a "red herring" is a distraction - something not relevant to the plot (or argument) that is thrown in to distract the audience (the voters). I'm sure if we tried, we could identify many fish in the administration's policy arguments, but I don't think this is one of them.
