If there has been no new thing developed (created is a loaded term, technically we can't create matter) there would be nothing to patent.

I personally believe God created the original DNA as I don't think there's any other good explanation.

That doesn't mean humans can't make changes in it .... via selective breeding or by more direct manipulation. Such changes would be intellectual property under our law.
