Yes but the crime is murder and/or assassination, not blackmail.

If I tell you I'm going to publish embarrassing details about you, and I do, that's not blackmail. If I tell you I am going to do so and I don't, that's not blackmail. If I don't tell you, and I publish them, that's not blackmail.

Blackmail is when I tell you if you don't pay me, or do some other thing I want you to do, than I will publish them.

Its kind of funny as a crime, since it gives you a choice. Publishing isn't illegal, but if I just go ahead and publish them you don't have the choice. Arguably your better off if I give you the choice.
