The class action plaintiffs' attorneys are always going to spout general optimism, and if there was a smoking gun at their disposal, it would be in the consolidated amended complaint, which is a standard filing by which all attorneys who brought separate lawsuits get together to hammer out an agreed-upon complaint. The amendment process, however, does not mean that new information has surfaced since discovery probably has not yet started, and probably won't start for some time if Ancor files what is known as a motion to dismiss the case. The best way for you to get information is to ask the plaintiffs lawyer, who appears free with words, to send you a free copy of the amended complaint. The complaint is required to state claims of fraud with particularity, and tell the reader the precise nature of the inaccurate information, and the circumstances showing that the information disseminated or withheld from the public is fraud, and not mere mistake -- which is so often the case when someone looks at facts with 20-20 hindsight. Once you get a copy of the amended complaint, or the lawyer refuses to send you a copy, you can share the results with us. Thanks in advance. |
