There are standard formats right now, with no royalties being charged (QIC, DAT for example, and 8 mm which has no barrier to entry (SONY and EXBT are in that market now)). The argument from QNTM's point of view then is that if the market has adopted DLT, including all the tape library manufacturers, and users who would like to maintain read backward compatibility, the new format would have to be significantly better and cheaper than DLT - something that others have not been able to do to this point.

Another point on QNTM's side is that this HP/IBM/SEG product is being built in a commitee fashion, and we've seen vaporware not materialize in the past.
