1. Ultimately the Republicans did not do it now did they?

2. There is no constitutional basis for blocking judicial appointments with a filibuster. Never, at any time did the constitution, or its authors consider advice and consent to be a super majority.

The filibuster is for legislative purposes. Blocking the judicial nominations was an abuse of it.

Reconciliation is intended strictly for budgetary matters. Passing legislation with it, is an abuse of it.
