It appears Obama will still have a democrat Senate after next January. He won't be completely neutered.

Perhaps Stephens announcing an intent to retire is supposed to be a catalyst for Republicans to win enough Senate seats to have a voice in his replacement. The way democrats have behaved in the last decade on judicial nominations would certainly justify rejection of Obama's first ten choices for the SCOTUS.
