I think you are misreading if you think that there isn't a consensus on that.

If they did, if they saw this as a structural flaw in the lightly regulated, private insurance approach to national health care, we would long ago have gone to a single payer system. So the consensus is either that it's ok for private insurance to operate that way or we've got ours so who cares. In effect, agreeing that it's ok.
