The point is that caring for a severe injury can be very expensive. It is not a time for relinquishing oneself solely to the mercies of the State, if such could be avoided.

In 30+ years of practice, mostly on the defense side, I have defended many personal injury suits that I considered non-meritorious. But, I don't share the view that the tort system needs to be jettisoned. Much of that discussion is conducted by people who are not particularly knowledgeable about the system.

In CA, we have had MICRA limitations on medical malpractice suits for as long as I have been practicing. And the limits haven't changed in all that time. I haven't looked at the practice in other states, but that model seems efficient to me.
