I haven't looked at the practice in other states, but that model seems efficient to me.

I assume that the vast majority of the cases never see a courtroom. I believe it's to the financial advantage of the Lawyers working for the Ins cos to spin the cases out if they are getting paid by the hour. Things are settled out of court.

So courtroom decisions are a small factor of the problem
