TG, if you will Google the phrase "as construed and applied", you will see what I am referring to. Statutes are tested for their constitutionality as they are "construed and applied". If an individual state opts out of the individual mandate, the constitutional objection disappears. The statute would then be made constitutional by the way it is "construed and applied".
