In the United States, the federal government generally considers a crime punishable with incarceration for one year or less to be a misdemeanor. en.wikipedia.org While O'Keefe performed a great service by exposing Acorn, he needs to understand that he has made himself a target. Unfortunately, he gave the left a big stick to hit him with. He should have consulted with an attorney before entering Landrieu's office.
