My view:

If looks like GFL took an aggressive approach to increase their returns, because of the lack of clarity by the regulators. GFL knew they were walking a thin line, but they pushed the envelope until someone said uncle. They saw a loop-hole and used it to their advantage until regulators were forced to make it more clear.
