You don't need a part that says its unconstitutional for it to be so, you only have to lack a part that makes it constitutional. The feds are granted powers by the constitution, if they are not granted a power to do something, than its unconstitutional for them to do so. (The states on the other hand can do whatever isn't forbidden by the constitution, and the feds have ways to pressure states to do things, they could have constitutionally gotten a mandate passed that way.)

How about 200K deaths due to hospital mistakes?

I don't see that as something the US does poorly in compared to other countries. I've only seen data for the US and Canada, but Canada does about as bad once you consider its much smaller population. I think it does just slightly better, but not enough for the different to be an important factor. Also it might do slightly better because people who don't get treatment (get put on waiting lists for a long time, and perhaps never get the treatment or at least have it delayed and probably get less treatment overall) don't die from the treatment. It may be a tiny dark lining in the silver cloud of our system being the most responsive in the world.

Survival rate from colon cancer...?

I don't have the specific data from colon cancer, but generally the US has higher survival rates from cancer.
