That seems to be a rather odd spin. I'd go further and say its outright false. The bill could have been written to amend the tax laws and create such a tax category but it did not, it created a mandate and a penalty.

Even if it had been written as a tax category change it would still be a bit dubious in terms of constitutionality, a very specific punitive tax can reasonably be seen as more of a punishment than a tax change. But I guess its not worth spending too much time analyzing that, since it wasn't written that way and I don't see anyone arguing to change that point.
