My original loan had no points so there are no points hiding in the loan. My mortgage broker was indicating that some people have indicated to him that the new points on the refinance are deductible upfront and he believes this to be the case. He claims no expertise in this matter.

Do I understand this correctly?

Before the appeals case the loan points on a refinance were amortized over the life of the loan.

After the appeals court case I can now deduct the points for my soon to be aquired refinance (loan with no additional borrowing) upfront?
