That can be the case, but it takes a BS artist, correction a legal BS artist, to know one and expose one. And you have to talk legal BS in terms to which the judge/justices can relate.

As far as the clash of constitutional rights go--which does happen--you have to develop the legal history of each--and then make a legal argument as to why the one should prevail over the other.

Its a lot of burning the Midnight oil (usually by highly paid younger associates). Its not something easily done without training and even if were possible for one to do it without training it would be hard to get the command and respect from those in the profession as they would see you as an outsider who hasn't paid his dues.
