The key words in your post: "Its a lot of burning the Midnight oil (usually by highly paid younger associates)." The Justices themselves don't do the hard part. They just pontificate and "judge"/"decide". They take the arguments they like, the ones that justify the position they want to support, and use them. They don't have graders with any power to tell them that their "logic" or their history is wrong. Or perhaps better, they will have plenty of people telling them that they are wrong, but they also will have plenty of people telling them that they are right. Which means they will go home at night and sleep well whatever their decision happened to be, because they will simply dismiss the people who say that their decision was wrong.

You don't have to be a lawyer to do that. Just have a modicum of cleverness, and a talent for rationalization. Something that many people have an abundance of.
