Hopefully I can help clarify some of the dilemmas employers are face.

If it were as simple as making the employers completely responsible, I would agree, but they also have to comply with federal rules and regulations that mandate the terms of employment, and if they go beyond those federal directives, they run the risk of non compliance with government directives, etc.

What would appear to be a simple solution has become burdened with government created and mismanaged bureaucracy.

We are seeing that now with folks berating Obama and his lack of action with the oil spill, as we did with Bush and Katrina.

We saw it with the lack of cooperation between enforcement agencies leading up to 9/11.

Bottom line is, we, as a nation, have little to no patience, and unfortunately, no willingness to ferret out the actual truths!
