I sent the following request for information to Novonyx:

As a holder of 10K shares of NOVL it is of major concern to me that the sole purpose of
Novonyx at this point appears to be releasing products in direct competition with Novell as fast as
possible. The PR fluff available on Novonyx is a far cry from a reasonable explanation for a
publicly held company (Novell) to set up a secret organization (Novonyx) to act as direct
competition.

If the FAQ section of the Novonyx site were accessible I am sure the most frequently asked
questions would include some of the following:

Were former Novell employees given generous severance allowances before being sent to
Novonyx?

How much money did Novell invest in Novonyx and what percent of ownership does Novell have
in Novonyx?

What rights and control does Novells' ownership give Novell over Novonyx?

Will Novell receive revenue from Novonyx and how much?

Other than Novell, who owns Novonyx and what investment was made for what percent of
ownership?

I will post a copy of this request for information on the Internet and will follow it up with your
response or lack of response.

It'll be interesting to see what comes back.

Jims' reference to bad numbers leaking out doesn't sound good. Then again all the leaks last quarter were the exact opposite of the results. Zacks just upgraded NOVL from Strong Sell to Hold for whatever that's worth. I also notice that the EPS estimates in the fundamental section have increased to .04, which also doesn't mean much and is why they call it a "surprise". I really don't see how they could blow such easy numbers, but their marketing still stinks and there is no way to gain new business without effective advertizing.

Although the company "Is not for sale", there has never been any attempt to deny the possibility of a merger. In spite of the lack of detailed information surrounding the Novonyx deal, it does appear that the two technologies blend well.

The charts don't look all that great right now, and I don't like being behind, but after all this time I just have to see the numbers on the 26th. If it's bad I'll play the hell out of it for 1/4s until I'm even again.
