Ed, from other posts on the Board, I understand that the plaintiffs in the "big" class action lawsuit, which is one of several hunfred pending nationwide against scores of companies, have not yet filed their "real" complaint, although whatever they may add will not be based upon nonpublic information obtained from the company in discovery -- because there has been no discovery. Inevitably, that final form of complaint will be tested by a motion to dismiss -- which may end the lawsuit. From there, the plaintiffs have to attempt to establish the existence of a class, and that one of the plaintiffs named in the lawsuit adequately represents the class. Next, the plaintiffs must prove knowing misstatements or omissions. All of the foregoing is not a given, and no one on this Board, myself included, has any clue about where, if anywhere, the class action lawsuits is going. It is unreasonable to speculate one way or another about the likely outcome. |
