The argument for qualified immunity is that we don't want state employees hampered by fear of lawsuits when they're making important decisions

But apparently having people in the private sector be hampered by fear of lawsuits when their making important decisions is just fine. Or maybe some people don't think decisions in the private sector are important (unless their the wrong decisions, then they can be used to blame corporations, markets, etc., so that arguments can be made for more government control).

People tend to act differently when there's less chance that they'll be held accountable for their actions.

It would be nice if their was a more efficient and effective way to hold people accountable for their actions than our current tort system.
