Now you know why the oil and gas industry wrote most of the Oil Pollution Act of 1990 the way they did.

The "Responsible Party" is wholly responsible for stopping the flow and cleaning-up the mess, until their laughably low $75 million cap is reached. At that point the "Responsible Party" can remain in control by waiving the relief of the $75 million cap.

OPA-90 enabled the oil and gas industry to maintain their regulation-lite status after the Exxon Valdez spill.

In order to place the government in charge of the spill would require an amendment to OPA-90, if we're a society of law - which is debatable.
