I also think BP is not "toast" but for different reasons. The people taking money from BP now for damages are, I'm sure, signing waivers taking their right to sue away.

The people that do sue will end up in court forever. BP will coldly calculate the cost/benefit of settling vs. continuing litigation, and make the bottom line decision. BP will nickel and dime the people of your Riviera until the end of time. I'd be amazed if BP ends up paying more than a dime for every dollar of real damages.

Look at the Union Carbide chemical plant failure in Bohpal, which ended up taking the lives of 20,000 Indians, and harming many more, even to this day. It cost Dow, who acquired them, 525 million dollars. After 26 years of litigation, a few executives were sentenced to a couple of years in jail, just the other day.
