Absolutely.

This is the equivalent of kicking someone who is down, taking advantage of them. Obama has been successful in demonizing BP, and the result is they are not in a position to defend themselves. Due in no small part to the ignorance of the public, I might add. Not to say BP didn't make mistakes, use poor judgment or even commit crimes.

But what we know is they haven't received due process to which they are entitled under the law.

OTOH, BP's commitment was not that great -- in effect, they have to pay in four annual installments of $5B/year rather than as the money drips out. And a trustee will decide how the money is spent (but there is nothing, at all, to keep them from cutting off the money).

The Big Question is why, after the treatment they've received from Obama, were they willing to give him glory? And for that matter, the OTHER glory they've heaped on him during this process?

Are they in an indefensible position? Or is it that they stand to benefit from Cap & Tax?

Something isn't quite right although I'm not sure what it is exactly.
