The question here is whether an entity is "shaken down" when that entity has already committed to making the payment. And I don't know the answer. To what extent did the threat of criminal prosecution play a role? BP clearly has shown no hesitation to spend the money it takes to solve the problem -- 2 billion and counting thus far. It doesn't matter. Obama is grossly incompetent and continues to show it on a daily basis.
