If that is his only defense, he is guilty as guilty can be.

Our justice systems suck big time. I've never agreed with this sort of loop hole. If the prosecutor or the cops mess up, that should be a separate issue, which they should be held accountable for apart from the defendants crime. It doesn't change anything about what the criminal did.

If it were me, I might have shot Haywood too but that is beside the point... 457 though, what kind of twinkie goes to a fight with a .22?
