The gays don't want these kind of decisions for precisely the reason stated. An amendment to the Constitution on Marriage would pass without a problem.

Defense of Marriage Act Decision [William Duncan]

The Boston decision lacks seriousness. The judge answered a question that wasn't being asked. He says the 14th Amendment requires that marriage be redefined, but the question was whether Massachusetts had to follow federal law in administering federal programs. This decision is a good argument for a federal amendment defining marriage.
