(NASDAQ:FAUX) announced today that it has been named as a defendant in a civil action brought in the United States District Court for the Southern District of New York by Hamilton Consulting Inc., and others. The suit involves claims based upon an alleged breach of contract arising out of previous unsuccessful discussions that the company had concerning a possible business combination. The company has previously disclosed the commencement of such an action in its filings with the Securities and Exchange Commission. The company is confident that there exists no basis for any liability and that it will ultimately prevail on the merits.
