The assumption of risk is a separate action than the cap on liability.

A cap is saying A may only get $B from suing C about issue D. That isn't "the government will make up the difference".

The government may choose to make up the difference. Or it may have already passed a law saying it will, but then the issue of the decision to pay the difference is different from the issue of the decision to cap liability. The latter might lead people to push for the former, and that push might succeed, but they are still too different actions.
