From august bankruptcy hearing
The Court: Well, what I want to do is enjoin the dissemination of any of this information to any competitor of the Debtor, period, with specific reference to those two, since they were named in the complaint. I don't care if you go to a university or someplace like that and get an expert chemist. If there's any question in the SEC's mind, if you want to come and disclose who it is, then we'll see if it applies to them.
Mr. Brigagliano: Well, your honor, would Solv-ex be a party to that discussion? I don't see how Solv-ex could be a party to that discussion.
The Court: I'm saying, if you have a question that your going to violate the terms of my agreement, you can come and ask for a ruling from me to say that this person or this company doesn't; then I assume Solv-Ex will be included. Otherwise, if I hear you've violated this agreement, you're going to suffer the wrath of con.
Mr. Brigagliamo: Oh.
The Court: I think there is no harm to the SEC, because it will not prevent them from continuing with their investigation, It's pretty narrow injunction, and it seems to me all the elements for injunctive relief have been met.
Further documents corrected reporter's error and con was changed to Khan as in Star Trek Wrath of Khan Paramount Movie. |
