And the disclosures and additional paperwork that are not required by law or regulation, are not real free-market items either, for the most part, they are put in place in response to lawsuits (to prevent them or comply with provisions of settlements). Sure people in the private sector made the decision to include them (which is not the case when they are regulatory requirements) but they did so in response to the court system which is a branch of government.

The disclosure statements are there to prevent fraud. They are the anti thesis of free market tenets which don't want any restrictions on trade. The problem with that of course is that there are bad people in the world who are hell bent on committing fraud.
