I doubt if this would ever happen in a Democracy. Does Mom and Grandma sue the
Power company after she spent all day preparing a special meal only to have it ruined
by the power company turning off the power 40 minutes before it is ready to come out
of the oven?

i like that, but these type of disputes are settled by claims and if not an act of god, usually settled before ligitation. a few more points.

1) the electric and private companies are doing just that. usually t.o.u. meters (time of usage). prodding the customer to consume on non peak hrs. this is usually done via hot water heaters, and as you stated air conditioning.

2) private companies not only now offer in conjuction with power company off peak rates but will hook up major appliances to a timing divise which allows usage during non peak cheap usage hrs. or limiting usage during peak hrs. some examples are washer and dryer, heating and air conditioning units, dishwasher, even range and oven. in my experience only moderate success but private companies are making money.

3) fiber-- many electric companies have private phone system and infastruce now in place (at a substantial saving to them).

4)some of the dark fiber is now being used as a package together with power as an enticment for industrial customers to stay with the power company. i know of no bids won yet, but i know they are out there.

5)all eyes are on california.

6) my personal opinion is regulation is powerful and to give it up will take more time than most think.
