Individual Liberty and Economic Freedom: Inseperable

It is preposterous to think that a man can be free socially and politically if he is not free economically. Is freedom of the press or freedom of religion possible if all means of production are controlled by the government? Of course not. Yet capitalism is constantly blamed for the violation of individual rights. Absurdly, many point to the Jim Crow laws of the post-Civil War south as an example of freedom being used against individual rights. As legal scholar Richard Epstein explains, nothing could further from the truth.

Quite simply, there is no way to economically exploit individuals by letting them leave. The entire system of segregation has, in some quarters, been grotesquely treated as though it were some form of market system, when in fact it was anything but. The key feature of a market system is ease of entry and exit, which puts pressure on all economic players.

By blocking exit from the South, the segregationists sought to limit the options open to blacks, whom they could exploit on the farm, in the city, and everywhere in between.

Institutional slavery must have the backing of a nation’s government in order to even exist. It was not private citizens who were responsible for the success of Jim Crow laws (though they certainly bear the guilt), it was government’s involvement that made the Jim Crow era possible.
