SIII stands a good chance of winning their defense against shareholder lawsuits. The lrgal climate is different now then it was a few years ago. We haven't had true tort reform, but the 9th Circuit is more friendly towards corporations who have retated earnings. Attorneys will have a hard time developing their burden of proof to hurt the company. SIII's restatement of earnings was hardly "unprecedented" and is not uncommon in the industry. Do we have evidence of substantial insider selling which would account for someone profiting from the information? If not, then shareholders took the risks like anyone else, and was at the mercy of temporary market conditions. Anyone considering this a penny stock, probably thought that IBM's move to copper will totally transform the industry and make germanium-arsenide obsolete.
